Microsoft settles lawsuit over Xbox
>> From seattlepi.nwsource.com:
[QUOTE]
Microsoft Corp. said Thursday it settled a patent-infringement suit in which a New York company was demanding $90 million in royalties on the Xbox video game system.

Financial terms weren't disclosed, Microsoft spokesman David Bowermaster said, adding that it was an "amicable agreement." The settlement cuts short a trial that started this week over the suit, filed by closely held PalTalk Holdings Inc.

In opening statements Monday, Tribble said that "Halo" first-person shooter games and the Xbox console on which they are played infringe two patents for inventions developed by MPath Interactive Inc. PalTalk bought the patents for less than $200,000, Microsoft's lawyer, David Pritikin, told the federal jury in Marshall, Texas.

EA's Brown: Longer Console Cycle, More Price Cuts Ahead
>> From gamasutra.com:
[QUOTE]
The current console cycle will be longer than in previous years, says Electronic Arts CFO Eric Brown -- which means the highest-growth period for software sales still lies ahead following further price cuts.

Speaking at the Wedbush Morgan Securities conference in comments listened in on by Gamasutra, EA's Brown noted that with two out of three platforms currently capable of rendering graphics in full high definition at 60 frames per second, there's just not much further they can go at the current stage of tech.

"I myself am not quite sure where we go from here," said Brown. "There's just no broadly-available consumer viewing technology beyond HD. You have to be a PC technophile with an ultra high resolution monitor to get past that."

Man files lawsuit against US Airways for lost Xbox 360
>> From news.cincinnati.com:
[QUOTE]
A Madeira man who is a student at Yale University claims in a lawsuit that US Airways stole a video game console from his luggage during a flight, and he wants $1 million in compensation.

In it, he noted that he took a Dec. 17, 2008, flight from New Haven, Conn., to Cincinnati/Northern Kentucky International Airport. Included in his luggage for that trip was his Xbox 360, which had a specialized hard drive and components he said cost more than $1,000.

When he picked up his luggage after landing, though, he noticed how light it was. He opened the bag, the suit noted, and he saw that everything was there except the video-game console and its accompanying components.

The suit seeks to have the airline pay him $1,700 for the loss of the gaming system and for "non-economic distress" of at least $25,000, but "in the maximum amount allowable by law or, in the alternative, in the sum of $1,000,000."

Halo Suit Seeks 90 Million USD
>> From seattlepi.nwsource.com:
[QUOTE]
The trial in Marshall, Texas, centers on technology for ways to control interactive applications over multiple computers. MPath was "a pioneer in the online video industry in the area of real-time, multiplayer online games," PalTalk lawyer Max Tribble told the jury.

Microsoft said it did review the MPath inventions and chose a different path in developing its games. The technology is for an older dial-up method of communicating between computers, and "the patents don't cover the way the 'Halo' games work," Pritikin said.

"Microsoft decided to go in another direction and work with another company," he told the jury. "Obviously, this was upsetting to PalTalk and its employees."

Microsoft also is challenging the validity of the PalTalk patents and told the jury that, even if it agrees with PalTalk, "the patents aren't worth much, certainly not $90 million."
